Privacy Policy

This Privacy Policy explains how SWATCHON (“SWATCHON,” “we,” “us,” or “our”) collects, uses, discloses, and protects information about you when you use our website, apps, and services (the “Platform”). It covers both buyers and suppliers using our international fabric sourcing, ordering, payment, and shipping services.


1. Who We Are & Scope

SWATCHON Co., Ltd. (Korea) and its affiliates, including SwatchOn USA Inc. (U.S.), jointly operate the Platform. This Policy applies to all users worldwide. Region-specific disclosures appear in Section 12.

2. Information We Collect

  • Account & Profile: name, business name, job title, email, phone, password (hashed), preferred language, country.
  • Business & Compliance: company registration data, tax/VAT IDs, resale certificates, import/export identifiers, KYC/verification records (where required).
  • Orders & Payments: items purchased, cart contents, prices, currency, payment method details (processed by PCI-compliant providers), billing and shipping addresses, invoices and receipts.
  • Logistics: shipment method, courier/tracking, customs documentation, duties/VAT estimates, delivery confirmations, return/RMA information.
  • Uploads & Content: artwork/files for custom print orders, messages to suppliers, reviews, support tickets.
  • Device/Usage: IP address, device and browser info, pages viewed, referral source, approximate location (from IP), cookies and similar technologies.
  • Marketing Preferences: newsletter opt-ins, communication choices, campaign attribution.

3. How We Use Information

  • Provide Services: create/manage accounts, process orders and payments, enable supplier listings, manage swatch requests and custom prints, arrange shipping, and provide customer support.
  • Improve & Personalize: diagnostics, analytics, A/B testing, quality assurance, localization, and content relevance.
  • Security & Compliance: fraud prevention, KYC/AML where applicable, sanctions screening, regulatory and tax compliance, dispute handling.
  • Communications: transactional messages (order updates, invoices), service announcements, and—if you opt-in—marketing communications.
  • Legal Bases (EEA/UK/CH users): contract performance; legitimate interests (e.g., security, improvement); legal obligations; consent where required (e.g., certain marketing or cookies).

4. How We Share Information

  • Suppliers & Buyers: we share order-relevant details between buyers and suppliers to fulfill transactions (e.g., ship-to data, product specs, artwork for custom print).
  • Service Providers (Processors): payments, KYC/verification, cloud hosting/CDN, analytics, customer support, email/SMS delivery, logistics and customs brokers—under contracts that restrict use to our instructions.
  • Affiliates: within our corporate group for operations consistent with this Policy.
  • Legal & Safety: to comply with laws, respond to lawful requests, enforce terms, or protect rights, safety, and property.
  • Business Transfers: related to merger, acquisition, financing, or sale of assets (with continued protection of your data).
  • No selling of personal information: we do not “sell” personal information as defined by many privacy laws. See Section 12 for regional wording.

5. International Transfers

We operate globally and may transfer your information to countries that may not offer the same level of data protection as your home jurisdiction. Where required, we use appropriate safeguards (e.g., EU Standard Contractual Clauses) and technical/organizational measures.

6. Data Retention

We retain information for as long as necessary to provide the services, comply with legal obligations (e.g., tax/accounting), resolve disputes, and enforce agreements. Retention periods vary by data category and jurisdictional requirements.

7. Security

We use administrative, technical, and physical security measures appropriate to the nature of the data. No system is 100% secure; please use unique, strong passwords and keep credentials confidential. Payment processing is performed by PCI-compliant providers.

8. Your Rights & Choices

  • Access, Rectification, Deletion: request a copy of your data, correct inaccuracies, or delete certain information (subject to exceptions).
  • Portability & Restriction: request portable copies or ask us to restrict certain processing.
  • Withdraw Consent: where processing is based on consent (e.g., certain marketing/cookies), you may withdraw at any time.
  • Object: to processing based on legitimate interests (including profiling), and to direct marketing.
  • Preferences: manage email preferences via links in messages or in your account settings.

9. Cookies & Similar Technologies

We use cookies, web beacons, and similar technologies to run and improve the Platform, remember preferences, authenticate users, analyze traffic, and measure marketing performance. See our Cookie Policy for details and choices.

10. Children

The Platform is not directed to children under 16 (or the minimum age required by applicable law). We do not knowingly collect personal information from children.

11. Custom Artwork & Uploaded Content

If you upload artwork or other files (e.g., for custom print), you are responsible for the content and for having the necessary rights. We and our suppliers process such files solely to provide the requested services (e.g., preview, proofing, production, and quality control).

12. Region-Specific Disclosures

California (CCPA/CPRA)

  • Categories Collected: identifiers (e.g., name, email), commercial information (orders), internet/usage data, geolocation (approx.), professional info (business account), and inferences for service improvement.
  • Purposes: as described in Sections 3–4 (service delivery, security, compliance, analytics, communication).
  • “Sale”/“Sharing”: we do not sell personal information for money. We may engage in cross-context behavioral advertising; you can opt-out where applicable.
  • Rights: know/access, delete, correct, opt-out of sharing for cross-context ads, limit use of sensitive data (if any), and non-discrimination. Contact support@swatchon.com.

EEA/UK/Switzerland (GDPR)

  • Controller(s): SWATCHON Co., Ltd. and affiliates. Contact support@swatchon.com.
  • Legal Bases: contract performance; legitimate interests (e.g., security/analytics); legal obligations; consent where required.
  • Transfers: safeguarded by appropriate mechanisms (e.g., SCCs).
  • Complaints: you may lodge a complaint with your local supervisory authority.

13. Changes to this Policy

We may update this Policy from time to time. We will post the updated version with a new Effective Date and, where required, provide additional notice. Your continued use of the Platform after the Effective Date constitutes acceptance.
